A deportation (removal) order may be lifted by filing an annulment lawsuit within 7 days. An annulment action filed against a deportation order automatically suspends the execution of the removal process.

Additionally, during the deportation process, individuals may be placed under administrative detention. Therefore, it is also possible to object to the administrative detention decision—which restricts personal liberty—before the Criminal Court of Peace.

Administrative Detention Decision and Objection

Foreigners who are not invited to leave the country voluntarily, as well as those who are invited to leave but fail to depart within the granted period, are placed under administrative detention in removal centers. Foreign nationals apprehended by law enforcement authorities are transferred to removal centers within a maximum of 48 hours.

The period of administrative detention may be up to 6 months. However, if deportation procedures cannot be completed due to the foreigner’s failure to cooperate with administrative authorities or failure to provide accurate information or documents regarding their country, this period may be extended for an additional 6 months.

Foreigners held under administrative detention in removal centers have the right to file an objection against this decision.

Lifting a Deportation Order Through an Annulment Lawsuit

A deportation (removal) order may be revoked by filing an annulment lawsuit before the administrative court within 7 days from the date the decision is notified to the individual. If a lawsuit is filed, the foreign national cannot be deported until the case is concluded.

The annulment lawsuit must be filed against the Governorship that issued the deportation order. The time limit to apply to the administrative court against a deportation decision is 7 days from the date of notification.

Deportation Inquiry
